Tarkle Creew, Inc.("Creew," "Tarkle Creew," "Creew Design," "us," "we," or "our") operates the https://creew.design website, applications, and social media sites. Tarkle Creew, Inc. is a Delaware corporation and a fully owned subsidiary of Tarkle Limited. These Terms of Service ("Terms") govern your access to and use of Creew's products and services ("Service").

By accessing or using Creew, you agree to be bound by these Terms. If you do not agree, please do not use this Service.

1. The Service

Creew is a design subscription service providing unlimited graphic design, video, motion graphics, website development (Webflow & Framer), and managed SEO support on a flat monthly subscription basis. You submit briefs through your project portal, and our team delivers work within the turnaround time specified on your plan. The scope of work covered under each plan is described on our services page.

2. Trial period

We offer a trial period as advertised on our website. The duration and terms of the trial may change at any time without prior notice. During your trial, you have access to the full Service. A payment method is required to start your trial. If you do not cancel before the trial ends, your subscription will automatically convert to a paid plan at the rate shown at sign-up. We may complete up to 1 project during your trial period. Trial availability is at our discretion and may be modified or discontinued.

3. License and use rights

Creew grants you a limited, non-exclusive, non-transferable license to use the Service for your personal or business purposes, in accordance with these Terms. You agree not to reproduce, resell, or exploit any portion of the Service without express written permission from Creew.

4. User accounts

To use Creew, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use of your account.

5. Subscription and billing

Creew offers monthly subscription plans. Your subscription renews automatically each billing cycle unless you cancel. You authorize us to charge your payment method for the subscription fee and any applicable taxes.

You may cancel at any time through your account settings. Cancellation takes effect at the end of your current billing period. See our Refund Policy for details on charges and refunds.

6. Intellectual property and deliverables

You retain ownership of all content you submit to Creew. By submitting content, you grant Creew a limited, non-exclusive license to use your content solely for the purpose of delivering the Service.

All work created by Creew on your behalf is owned by you upon receipt, provided your subscription is active and payments are current. Creew retains the right to showcase completed work in its portfolio unless you request otherwise in writing.

7. Acceptable use

You agree not to use the Service to:

• Create content that is illegal, defamatory, or infringes on third-party intellectual property.
• Submit briefs that request adult content, hate speech, or content designed to deceive.
• Attempt to circumvent security measures or access unauthorized parts of the platform.
• Resell or white-label the Service without a written agreement with Creew.
• Engage in automated data collection or scraping.

8. Service availability and quality

We aim to deliver work within the turnaround times stated on your plan. While we strive for high quality, creative output is subjective. We offer unlimited revisions within the scope of your original brief. Creew is not liable for missed deadlines caused by unclear or incomplete briefs, delayed feedback, or circumstances outside our control.

9. Third-party integrations

Creew uses third-party services including Stripe for payments. Your use of these services is governed by their respective terms. Creew is not responsible for the performance or policies of third-party services.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CREEW SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR USE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE THREE MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Creew and its affiliates, including Tarkle Limited, from any claims, damages, losses, or costs arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

12. Termination

Creew may terminate or suspend your account at any time if you violate these Terms or at our sole discretion. Upon termination, your right to use the Service ceases immediately, and your data will be handled per our Privacy Policy.

13. Modifications

Creew reserves the right to modify these Terms at any time. Material changes will be communicated via email. Continued use of the Service constitutes acceptance of the updated Terms.

14. Governing law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts in Delaware.
